Information We Collect

We may collect three categories of information:

  • Information you provide directly — such as name, phone number, email address, postal address, appointment preferences, and the contents of messages or attachments when you submit a contact form, request an appointment, or create an account if that feature is offered.
  • Information collected automatically — such as IP address, browser type and version, operating system, device identifiers, language settings, referring and exit URLs, pages viewed, time stamps, and approximate location derived from IP. This data is collected through server log files, cookies, pixels, and similar technologies, consistent with standard web hosting and analytics practices.
  • Information from third-party sources — such as service providers who help us host the site, deliver email, or measure traffic, and publicly available sources. We do not purchase personal information from data brokers for marketing purposes.

Geographic Scope of Our Services

Modern Optical NY provides eye-care and eyewear services from our office in Brooklyn, New York, to customers located in the United States. We do not market, sell, or ship our products or services to individuals outside the United States. Our website is intended for U.S. residents. If you access the site from outside the United States, you do so on your own initiative and are responsible for compliance with local law.

How We Share Information

We do not sell user information. Modern Optical NY does not sell, rent, or trade your personal information to third parties for money or other valuable consideration, and we do not share it for cross-context behavioral advertising as those terms are defined under the California Consumer Privacy Act (as amended by the CPRA). The limited disclosures described below are made only to operate our business and comply with the law. We may share information with:

  • Service providers — vendors who host our website, process forms, send email, or provide analytics, under contractual confidentiality and data-protection obligations limiting their use of the information to providing services to us;
  • Legal and safety — when required by law, subpoena, court order, or to investigate or protect rights, property, and safety;

Cookies, Analytics, and Tracking Technologies

We use cookies, pixels, and similar technologies to operate the site, remember preferences, and measure traffic. Cookies fall into the following categories:

Do Not Track and Global Privacy Control

Our website does not change its behavior in response to a browser's "Do Not Track" (DNT) signal because there is no common industry or legal standard for honoring DNT. Where required by applicable law (for example, the California Consumer Privacy Act as amended by the CPRA), we treat a recognized Global Privacy Control (GPC) signal as a valid opt-out of the sale or sharing of personal information for visitors detected to be in that jurisdiction. Because we do not sell or share personal information for cross-context behavioral advertising, a GPC signal will not change the limited data flows already in effect.

Biometric Information

As part of certain online services (for example, virtual try-on tools, frame-fitting tools, or online vision-related screenings, if offered), we may collect biometric or biometric-derived information, such as iris, retinal, or facial-geometry imagery and measurements derived from photos or video you submit. We treat this information as sensitive and apply the following commitments:

  • Notice and consent. We collect biometric information only after providing notice and obtaining your written or electronic consent at or before the point of collection, identifying the specific purpose and the retention period.
  • Purpose limitation. Biometric information is used only for the purpose you consented to (such as frame fitting, vision-related measurement, or fraud prevention) and is not used for advertising or sold to third parties.
  • No sale or trade. We do not sell, lease, trade, or otherwise profit from biometric information.
  • Retention and destruction. Biometric information is retained only as long as needed for the stated purpose and is destroyed when (a) the purpose has been satisfied or (b) within three (3) years of your last interaction with us, whichever occurs first.
  • Safeguards. Biometric information is stored using the same or greater protective measures as the most sensitive information we maintain, including encryption in transit and at rest where technically feasible and access controls limiting access to authorized personnel.
  • Deletion requests. You may request deletion of your biometric information at any time by contacting our Privacy Compliance Contact (see "Who We Are" above).

Health Information (HIPAA)

Health information you provide to Modern Optical NY in our office in connection with eye exams, prescriptions, or related care is protected by the Health Insurance Portability and Accountability Act (HIPAA) and is governed by our separate Notice of Privacy Practices, not this Privacy Policy. Do not submit detailed medical history, diagnoses, or other protected health information through general website contact forms, which are not designed for the secure transmission of PHI. If you need to share PHI, please call or visit our office.

Data Retention

We retain personal information only as long as needed for the purposes described in this policy, unless a longer retention period is required or permitted by law. Typical retention timelines include:

  • Contact form submissions and email correspondence — generally retained for up to twenty-four (24) months after the matter is resolved, then deleted or anonymized;
  • Appointment-related records — retained as required by applicable healthcare and recordkeeping laws;
  • Server log files — retained for up to ninety (90) days for security and troubleshooting, then deleted or aggregated;
  • Analytics data — retained per our analytics provider's default settings, typically fourteen (14) to twenty-six (26) months in aggregated form;
  • Biometric information — see "Biometric Information" above.

When information is no longer needed, we delete, anonymize, or securely dispose of it.

Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of personal information, consistent with the New York SHIELD Act and other applicable laws. Our program includes:

  • Administrative safeguards — designating personnel responsible for the security program; training staff with access to personal information; conducting periodic risk assessments; and performing due diligence on service providers, including contractual obligations to safeguard data.
  • Technical safeguards — encryption of personal information in transit using TLS (HTTPS); access controls and authentication (including unique credentials and, where appropriate, multi-factor authentication) limiting access to personnel with a business need; logging and monitoring of access to systems containing personal information; timely software updates and vulnerability remediation; and secure configuration of website forms and backend systems.
  • Physical safeguards — restricting physical access to facilities, servers, and records containing personal information; and securely disposing of paper and electronic records when no longer needed.

No method of transmission over the Internet or method of electronic storage is completely secure. While we use reasonable measures to protect your information, we cannot guarantee absolute security.

Your Rights and Choices

Subject to applicable law and to verification of your identity, you may have the right to:

  • Access the personal information we hold about you and obtain a copy in a portable format;
  • Correct inaccurate or incomplete personal information;
  • Delete personal information we hold about you;
  • Restrict or object to certain processing of your personal information;
  • Withdraw consent at any time where processing is based on consent (without affecting prior lawful processing);
  • Opt out of the sale or sharing of personal information and of targeted advertising — we do not sell or share personal information for cross-context behavioral advertising;
  • Non-discrimination — we will not deny goods or services, charge different prices, or provide a different level of quality because you exercised a privacy right;
  • Authorized agent — you may designate an authorized agent to submit requests on your behalf, with proof of authorization;
  • Appeal — if we deny your request, you may appeal by replying to our denial. We will respond within the time period required by applicable law.

We do not charge a fee for most requests but may do so where permitted (for example, for manifestly unfounded or excessive requests).

California Notice at Collection (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act (as amended by the California Privacy Rights Act) gives you specific rights. In the preceding twelve (12) months, we have collected the following categories of personal information:

  • Identifiers — name, email address, phone number, postal address, IP address, device identifiers;
  • Customer records — appointment requests, message content, account details if you create an account;
  • Internet/network activity — browsing actions, pages viewed, referring URLs, interactions with our site;
  • Geolocation — approximate location derived from IP address;
  • Sensory data — photos or video you submit to virtual try-on or similar tools (see "Biometric Information");
  • Inferences — limited inferences drawn from the above to operate and improve the site;
  • Sensitive personal information — biometric information used for identification or measurement; we use this only for the purpose disclosed and do not use it to infer characteristics about you.

Children's Privacy

Our website is not directed to children under 13, and we do not knowingly collect personal information from children under 13 online without verifiable parental consent, consistent with the Children's Online Privacy Protection Act (COPPA).
